Terms of Service

1. Agreement
These terms are an agreement between you and Breakaway Bicycles, Inc. (“Breakaway,” “we,” “us”) governing your use of this website and your rental reservations. By creating an account or placing a booking, you accept these terms. Each rental additionally requires a signed Rental Agreement & Release of Liability (the “waiver”) before equipment is handed over; if these terms and the waiver conflict, the waiver controls for that rental.
2. Who can rent
You must be at least 18 years old, hold a valid government-issued photo ID, and complete our identity verification. The name on your ID must match the name on the signed waiver. Bikes and gear for minors may be rented by a parent or legal guardian, who remains responsible for the equipment and the rider.
3. Reservations and payment
Prices are shown in U.S. dollars. When you book, your card is authorized for the rental total; the charge is completed once your identity is verified and the waiver is signed. Applicable sales tax is added to rental charges (security deposits are not taxed). Promotional and multi-day discounts, where offered, are applied as displayed at booking and do not stack — you automatically receive whichever single discount is larger.
4. Security deposit
Each rental carries a refundable security deposit, shown before you book. On pickup day we place a temporary hold for the deposit amount on your saved payment method. The hold is released after the equipment is returned on time and in the condition it left in. By booking, you authorize us to charge your saved payment method for damage, loss, cleaning beyond normal use, and late fees, as detailed in the waiver.
5. Cancellations and changes
Free cancellation for 30 minutes after booking. After that, cancel up to 24 hours before pickup for a $40 fee. Within 24 hours of pickup, give us a call.
The phone number for last-minute cancellations is in your booking confirmation email. Cancellation fees are deducted from your refund. Pickup and drop-off times can be adjusted from your account within 30 minutes of booking; after that, contact us.
6. Pickup and return
We are open daily 7 AM – 7 PM. Bring the ID of the person who booked. Helmets are required on every rental — borrow ours free of charge or declare that you are bringing your own. Staff will document the condition of the equipment with photos at pickup and again at return.
Return the equipment by your scheduled drop-off time. Late returns accrue a late fee for each day or partial day past the drop-off date, based on your booking’s daily rate, up to the amount of the security deposit. Occasionally we must close for weather or events; if a closure affects your booking we will contact you to reschedule or refund.
7. Delivery
Where offered, delivery is available within our Houston service area for a fee based on driving distance, quoted before you book. You must provide an accurate street address, and someone 18 or older must be present to receive the equipment, show ID, and take handover. Addresses outside our service area cannot be served.
8. Right to refuse service
We may decline, cancel, or end any rental at our discretion, at any point — including at pickup or when we arrive with a delivery. Examples include a renter who cannot present a matching ID, appears impaired or unable to ride safely, is abusive toward staff, a delivery location that is unsafe or inaccessible, or a reasonable belief that the equipment will be misused.
If we decline service before equipment is handed over, we will refund your rental charges and release the deposit hold; a delivery fee may be retained when the refusal is due to unmet requirements at the address (for example, no adult with a matching ID present to receive the bikes). If a rental is ended early for a violation of these terms or the waiver, the equipment must be returned immediately and unused time is not refunded.
9. Using the equipment
During your rental you agree to:
- obey all traffic laws and ride at your own risk;
- not ride under the influence of alcohol or drugs, and not let anyone outside your booking use the equipment;
- use the equipment only as intended — one rider per bike (two on a tandem), no stunts, racing, or off-road use of road equipment;
- lock the bikes when unattended and report theft, loss, or damage to us immediately.
You are responsible for the equipment from pickup (or delivery handover) until we take it back. Loss, theft, or damage beyond normal wear may be charged as described in the waiver.
10. Assumption of risk and liability
Cycling is a physical activity that carries inherent risks, including serious injury. The signed waiver governs assumption of risk, release of liability, and indemnification for each rental. To the maximum extent permitted by law, our total liability arising out of a rental or use of this website is limited to the amount you paid us for that rental, and we are not liable for indirect, incidental, or consequential damages. The website and equipment are provided “as is” except as required by law.
11. Accounts
Keep your sign-in credentials confidential; bookings placed through your account are your responsibility. We may suspend or close accounts used fraudulently or in violation of these terms.
12. Governing law
These terms are governed by the laws of the State of Texas. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Harris County, Texas.
